The\ncomplaint alleges that streetlights owned by Hawaiian Electric\nCompany\, Inc. and Maui Electric Company\, Ltd.\, and operated on the\nCounty’s behalf\, are a threat to the survival and recovery of three\ncritically imperiled seabirds that are native to Hawai‘i and protected\nunder the Federal Endangered Species Act.\n2. County of Maui\, et al.\; Civil 2CCV-24\n-0000903\, filed on September 26\, 2024. The claim alleges negligence\nand respondeat superior or vicarious liability against the County arising\nfrom an incident between Martin and a motor vehicle driven by Maui\nPolice Department Officer Mitchell Navarro that occurred on February\n5\, 2023\, within the parking lot area of Kepaniwai Park in Wailuku\,\nHawai‘i.\n2.
