Resolution 26-129\, entitled “REFERRING TO THE MAUI PLANNING\nCOMMISSION A PROPOSED BILL TO AMEND THE KIHEI-MAKENA\nCOMMUNITY PLAN AND WEST MAUI COMMUNITY PLAN AND A\nPROPOSED BILL TO CHANGE THE ZONING FOR A-1 AND A-2\nAPARTMENT DISTRICT PROPERTIES IN THE SEA LEVEL RISE\nEXPOSURE AREA.” Resolution 26-129’s purpose is to refer to the\nMaui Planning Commission a proposed bill to amend the\nKihei-Makena Community Plan and West Maui Community Plan and a\nproposed bill to change the zoning for Apartment District properties in\nthe Sea Level Rise Exposure Area to allow for continued Transient\nVacation Rental uses.\nThe Sea Level Rise Exposure Area is\ndetermined by using the County’s recognized planning threshold for\n\nMORE à\n\nPage 2\n\nwww.MauiCounty.us/HLU\n\ncoastal erosion at 3.2 feet of sea level rise as identified in the Hawai‘i\nSea Level Rise Viewer. The Community Plan Amendment bill would\namend the Kihei-Makena Community Plan to designate applicable\nproperties as Hotel and the West Maui Community Plan to designate\napplicable\nproperties\nas\nResort/Hotel\,\nand\nmake\nconforming\namendments to the community plans’ text. The Change in Zoning bill\nwould grant a Change in Zoning to the H-3 Hotel District for applicable\nproperties in the A-1 Apartment District and to the H-4 Hotel District for\napplicable properties in the A-2 Apartment District.\nThe properties affected are:\na. Island Sands\, 150 Hauoli Street\, Mā‘alaea\, Hawai‘i\;\nb. Maalaea Kai\, 70 Hauoli Street\, Mā‘alaea\, Hawai‘i\;\nc. Kihei Bay Surf\, 715 South Kihei Road\, Kīhei\, Hawai‘i\;\nd. Kihei Bay Vista\, 679 South Kihei Road\, Kīhei\, Hawai‘i\;\ne. Lokelani\, 3833 Lower Honoapiilani Road\, Lahaina\, Hawai‘i\;\nf. Hale Ono Loa\, 3823 Lower Honoapiilani Road\, Lahaina\, Hawai‘i\;\ng. An Amendment Summary Form\, dated July 30\, 2026\, from the\nCommittee Chair\, to add a new section to the proposed Community\nPlan Amendment bill attached as Exhibit “1” to the resolution\, to\nconform the Kihei-Makena Community Plan text at Part V\, A\, “Land\nUse Categories and Definitions\,” for the “Hotel (H)” designation.\n3. Correspondence dated July 30\, 2026\, from the Committee Chair\,\ntransmitting a list entitled “Apartment District Properties Allowed to be\nUsed for Short-Term Occupancy\,” dated June 27\, 2024. The same list\nis attached to the agenda as Exhibit “1.”\n\nStatus: The Committee may consider whether to recommend adoption of\nResolution 26-129\, with or without revisions.\nThe Committee may\nconsider revising Resolution 26-129 to add properties consistent with the\nResolution’s purpose to the attached proposed bills from the list of\nApartment District properties attached to the agenda as Exhibit “1.” The\nCommittee may also consider revising Resolution 26-129 to remove\nproperties from the attached proposed bills.
